The Department of Commerce, Bureau of Industry and Security (formerly BXA, now BIS) promotes the National Security, Economic Security and Foreign Policy Interests of the United States by managing and enforcing the Department's Security-Related Trade and Competitiveness Programs. Specifically, BIS is the primary licensing agency for DUAL USE EXPORTS (items that have commercial uses), however also may have potential military applications. The BIS is governed by the Export Administration Regulations (EAR). Which can be found in Title 15 of the Code of Federal Regulations (CFR), parts 730-774. Before you export, you must determine whether or not your item requires an export license. Below are four very basic things you must know before shipping items that may be controlled the Department of Commerce:


1. What are you exporting? What is the ECCN, Export Control Classification Number?

2. What is the ultimate destination of your item?

3. Who will receive the item?

4. What is the ultimate end-use?

Once you determine the above information, you then determine if an export license is required by:
1.
reviewing the Regulations
2.
contacting BIS for consultation, and/or
3.
attending one of the many one- or two-day seminars put on by BIS to help exporters comply with the Export Administration Regulations.
